It is important to note that an arrest simply means that the police believe there is probable cause that the person committed a crime. A person is presumed innocent unless and until guilt is proved beyond a reasonable doubt to a jury of his or her peers. After arrest, it is the State’s Attorney’s Office that makes the decision on what if any charges will be filed. And it is the court that determines whether in fact there is probable cause that a crime has been committed. 

In some cases, I may be able to stop charges from ever being filed. As a criminal defense lawyer, I am able to perform my own investigation into the incident as opposed to relying solely on what the police claim happened or what police claim that a witness said during their investigation.
